Fresh Start Funding LLC DBA OpenWallet (“OpenWallet,” “we,” “us,” or “our”) oversees this website, www.openwalletusa.com (“Site”) and related services, including without limitation, the OpenWallet, LeadFarm, and Fresh Start Funding brands (collectively, our “Services”). We have developed this Privacy Policy to inform users (“user(s),” “you,” or “your”) about how we collect information in the course of conducting our business, including on the Site, how we use the collected information, and a user’s rights with respect to the collected information. We use Non-Personal Information collected by clickstream information collection, web pixels, and cookies to store your preferences, improve website navigation, make personalized features and other services available to you, to generate statistical information, monitor and analyze user traffic and usage patterns, monitor and prevent fraud, investigate complaints and potential violations of our policies, to improve the products, services, materials, and other content that we describe or make available through the Services, and otherwise help administer and improve the Services.

    We may, from time to time, invite you to participate in online surveys. The information requested in these surveys may include, but is not limited to, your opinions, beliefs, insights, ideas, activities, experience, purchase history, and purchase intent regarding products, events, and Services.   1. How We Share Information. We may share Personal Information with the following parties:
    1. Service providers that help us administer and provide the Services (for example, a web hosting company whose services we use to host our platform). These third-party services providers have access to your Personal Information only for the purpose of performing services on our behalf. While we may seek to require such third parties to follow appropriate privacy policies and to prohibit them from using your Personal Information except for the express purpose for which it is provided, you agree that we do not bear any responsibility for any actions or policies of third parties.
    2. Authorized third parties, who are parties directly authorized by you to receive the applicable Information, such as when you request for us to process a payment to a merchant or other service provider. The use of your Information by an authorized third party is subject to the third party’s privacy policy;
    3.   1. Information Security. We take reasonable steps online and offline to safeguard the Personal Information that you provide to us. OpenWallet’s online portal is certified as a Level 1 Service Provider, this being the highest security level available.
    We have several levels of security built into the system for our Customers. This includes the following security services:
    1. Cryptography and Encryption of sensitive information inside payment system;
    2. Quarterly scans of payment system performed by Qualified Security Assessor;
    3. Annual Audit performed by Qualified Security Assessor;
    4. Completion of Level 1 PCI Compliance Assessment;
    5. Encryption of card details, preventing card information from being exposed once transaction is complete;
    6. Secure receipts exposing only last 4 digits of card number; and
    7. Enforcing security-code confirmation every 30 days for merchant log-ins.
  1. It is common knowledge that transmission of information via the Internet is not wholly secure, and we cannot guarantee or warrant the security of your Personal Information, or any other information, transmitted to or through our Site or Services or otherwise provided to us, and we cannot be responsible for the theft, destruction, or inadvertent disclosure of such information. It is your responsibility to safeguard any passwords, ID numbers, or other special access features associated with your use of the Service(s). Any transmission of information is at your own risk.

  1. Information Retention. . We retain the Personal Information we receive as described in this Privacy Policy for as long as you use our Site or as necessary to fulfill the purpose(s) for which it was collected, provide our products and services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.
  1. Third-Party Information Tools. . We use a number of third-party tools when providing payment processing services to our clients. For example, we use “Google reCAPTCHA” (“reCAPTCHA”) when providing payment processing services to our clients. reCAPTCHA is used to combat fraud and verify that data has been entered by our users rather than an automated program. This entails collecting a variety of pieces of data from users, including IP address, how long the user has been on the website, or mouse movements made by the user. This information is then shared with Google to confirm that data is not being entered by an automated program (and likely fraudulent).   1. Links to Third Party Sites. The Site may contain links to other sites that are not operated by us. If you click on a link to another site, you will be directed to that third party’s site. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services.   1. Children’s Privacy. We do not sell products or services for purchase by anyone under the age of thirteen (13). In accordance with the Children’s Online Privacy Protection Act (“COPPA”), we will never knowingly request or solicit Personal Information from anyone under the age of thirteen (13) without verifiable parental consent. In the event that we receive actual knowledge that we have collected such Personal Information without the requisite and verifiable parental consent, we will delete that information from our database as quickly as is practical. We reserve the right to request proof of age at any stage so that we can verify that minors are not using the Service(s).

California Civil Code Section 1798.83 permits California residents to request and obtain a list of what Personal Information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year and the names and addresses of those third parties.
